Overview

 
 

When you get divorced, you and your spouse will agree to, or the court shall determine, the specific division of your assets and liabilities.  Florida is instead considered an "equitable distribution" state. This means the court decides what is fair or equitable as it relates to property division, which does not always result in an equal division; however, the court must begin with the premise that the distribution should be equal unless there is a justification for an unequal distribution based on all relevant factors set forth in Section 61.075, Florida Statutes.
